Terms and Conditions

Welcome to Made by  Mallory bakery. By accessing or using our website www.madebymallory.us and placing orders with us, you agree to be bound by the following Terms and Conditions. Please read them carefully before using our services. If you do not agree with these terms, please do not use our website or services.

1. General

1.1 These Terms and Conditions govern the sale of products and services provided by Made by Mallory Bakery through our website, social  media, email, or in-person. 1.2 We reserve the right to update or modify these Terms and Conditions at any time without prior notice. Changes will be effective upon posting to the website. Your continued use of our services after changes are posted constitutes acceptance of the updated terms. 1.3 All products and services are subject to availability, and we reserve the right to refuse service to any customer at our discretion.

2. Ordering

2.1 Orders can be placed through our website, by email, by phone, in-person, subject to availability. 2.2 All orders are subject to acceptance and confirmation by Made by Mallory bakery. We reserve the right to decline or cancel any order at our discretion, with a full refund provided if payment has been made. 2.3 Custom orders (e.g., cakes for special occasions) require sufficient lead time as specified on our website or at the time of ordering. We cannot guarantee acceptance of last-minute custom orders. 2.4 It is your responsibility to provide accurate and complete order details, including delivery/pickup preferences, special instructions, and contact information. We are not responsible for delays or errors resulting from incorrect or incomplete information provided by you. 2.5 Allergen Information: Our products may contain or come into contact with common allergens (e.g., wheat, dairy, eggs, nuts, soy). Please inform us of any allergies or dietary restrictions when placing your order. We cannot guarantee that our products are free from traces of allergens.

3. Pricing and Payment

3.1 All prices listed on our website or on Square, our payment processor, are in USD. 3.2 Prices are subject to change without notice. The price at the time of order confirmation applies to your purchase. 3.3 Payment must be made in full at the time of placing the order unless otherwise agreed. We accept all major credit cards, debit cards, check and cash, required at the time of order. 3.4 For all orders, payment is due at time of order to book our bakery services. 3.5 In the event of a pricing error on our website, we reserve the right to cancel the order and issue a full refund.

4. Delivery and Pickup

4.1 We offer delivery and pickup as specified at the time of ordering. Delivery is subject to availability and geographic restrictions. 4.2 Delivery times and dates are estimates and not guaranteed. We are not liable for delays caused by circumstances beyond our control (e.g., traffic, weather, or incorrect delivery information). 4.3 You must provide a valid delivery address and ensure someone is available to receive the order. We are not responsible for spoilage or damage to products if no one is present to accept delivery. 4.4 Pickup orders must be collected at the agreed time. Uncollected orders may be disposed of after 12 hours, and no refunds will be issued. 4.5 Delivery fees, if applicable, will be clearly communicated at the time of ordering.

5. Cancellations and Refunds

5.1 Standard Orders: Orders may be canceled with a full refund if notice is provided at least 14 days before the scheduled pickup or delivery time. Cancellations after this period may not be eligible for a refund. 5.2 Custom Orders: Due to the personalized nature of custom orders, cancellations may not be refundable. Retainers for custom orders are non-refundable. 5.3 All sales are final once an order has been picked up or delivered. 5.4 If you are dissatisfied with your order, please contact us within 12 hours of receipt at contact@madebymallory.us. We reserve the right to determine whether a refund or replacement is warranted based on the circumstances. 5.5 Orders are bound by Made by Mallory bakery's RETURN AND REFUND POLICY.

6. Product Quality and Liability

6.1 We strive to provide high-quality products, but minor variations in appearance (e.g., color, design) may occur, especially for custom orders, and do not constitute grounds for a refund. 6.2 Our products are perishable and must be stored according to our provided instructions. We are not responsible for spoilage or damage due to improper storage or handling after delivery or pickup. 6.3 To the fullest extent permitted by law, Made by Mallory Bakery shall not be liable for any indirect, incidental, or consequential damages arising from the use or consumption of our products.

7. Intellectual Property

7.1 All content on our website, including images, designs, and text, is the property of [Made by Mallory Bakery or our licensors and is protected by copyright and other intellectual property laws. 7.2 You may not reproduce, distribute, or use our content for commercial purposes without our prior written consent.

8. Privacy

8.1 Your personal information is collected and processed in accordance with state and federal laws. 8.2 By placing an order, you consent to the collection and use of your information.

9. Force Majeure

9.1 We are not liable for delays or failure to fulfill orders due to events beyond our control, including but not limited to natural disasters, power outages, or supplier issues.

10. Governing Law

10.1 These Terms and Conditions are governed by the laws of Iowa, USA.

Return and Refund Policy

Thank you for choosing Made by Mallory bakery. We strive to provide high-quality baked goods and exceptional service. Please review our return and refund policy below:


All Sales Are Final

  • All purchases made at our bakery are final. We do not offer returns, refunds, or exchanges for any products, including but not limited to cakes and cupcakes, pastries, macarons, or any and all other baked goods.
  • This policy applies to all orders, whether placed online, via email, through social media, or over the phone.


Order Fulfillment

  • By picking up or collecting your order, or by accepting delivery of your order, you acknowledge that the order has been fulfilled as requested and meets your expectations.
  • It is the customer’s responsibility to inspect the order at the time of pickup or delivery to ensure it matches the order specifications (e.g., type, quantity, design, or customizations).


Customer Responsibility

  • Please review your order details carefully before pickup or delivery. Any issues with the order (e.g., incorrect items, damages, or discrepancies) must be reported at the time of pickup or delivery.
  • Once the order is accepted, it is considered fulfilled, and no returns, refunds, or exchanges will be provided.


Exceptions

  • In the rare event that our bakery makes an error in fulfilling your order (e.g., providing the wrong item or failing to meet agreed-upon specifications), please notify us immediately at the time of pickup or delivery. We will assess the situation and, at our discretion, may offer a replacement or store credit.
  • To report an issue, please contact us within 12 hours of pickup or delivery at contact@madebymallory.us. Issues reported after this period will not be eligible for resolution.
